Backing up in the parking lot at a Department of Motor Vehicles location in Virginia, Antoinette Bowser hit a parked car. Moments into her driver’s test, she had already failed. As comical as the story seemed then, Bowser isn’t laughing now. In fact, today she’s worrying where she’s going to find thousands of dollars to pay for her motor mishap.
Two years after the failed road test, the state of Virginia is suing Bowser for $75,000. According to the Virginian-Pilot, Bowser is being sued for the medical expenses and lost wages of the DMV employee who administered her test.
Having put the incident behind her, Bowser was stunned when she was notified of the lawsuit.
“I was in tears," Bowser told the Pilot. "I don't have $75,000 laying around. I'm just making it like everybody else."
The state claims that Bowser hit the parked car with such "force and violence" that Geralynn P. Banks, the employee administering the road test, suffered "great pain of body and mind."
But Bowser remembers the incident differently.
"I know I walked away. And I know she walked away," she said.
Banks, meanwhile, declined to comment.
DMV spokeswoman Melanie Stokes told the Pilot that approximately 70 Virginia DMV employees filed workers compensation claims related to driver’s test accidents since January 2007, but the DMV doesn’t have statistics on the number of lawsuits that have resulted from these crashes.
Bowser’s lawyer Allan Zaleski has still not received any documents from the state specifying the injuries that Banks claims to have suffered and the expenses that they expect Bowser to pay. He told the Pilot that insurance companies would normally fight the suit, but the car Bowser was driving that day was uninsured.
For now, Bowser, who still hasn’t gotten her driver’s license, is sticking to buses… at least she’s saving money on gas.
